Accidental Death & Dismemberment Policy Question

I posted awhile back about my late husband’s AD&D policy. He passed in August of 2021 in a hit and run. He was a walking pedestrian and was hit by a car and was declared deceased at the scene. I have had MetLife ask for the accident report and now they are asking for the toxicology report. My husband’s death certificate states “accidental” as the cause of death. I’ve given them the information for the detective on the case and filled out consent forms for the coroner to release information they are asking for. The case is still open due to the driver fleeing the scene, all we have is a description of the vehicle and no further leads.. I still have not received a response or decision. Last I heard from MetLife was back in December of 2022.

If my husband was under any type of influence while he was hit, would that give MetLife a reason to deny the AD&D benefit? I would hope not, as he was walking when he was hit. Any help/info is greatly appreciated. Wow..I didn’t think I’d be asking this question at the age 29..so to type it out is surreal.
