Will being declined a claim affect having an exclusion removed? (income protection insurance)

Hi. I have income protection insurance. I have an exclusion on the policy. I have remedied the reason the exclusion was put on, and am waiting the 3 year (?) stand down to apply to have it removed.

However, in the meantime, I have been declined a claim under that exclusion. Will this affect my chances of having the exclusion removed?

I have called the insurer and the chap answering the phone said that exclusion removal is based on the medical situation at time of application only. However, he is not the underwriter.

Now, I see the use of the exclusion on my claim as inappropriate. I could argue it now, but I need to decide if it is worth it.

If being declined cover will have a limited impact on removing the exclusion in the future, I will move on with life. If it will be significant, there is more reason to fight it.

Background:

The use of the exclusion by my insurer has been called ‘aggressive’ by my broker. I’d say I have a fair chance to have the exclusion repealed but I have already progressed things as far as possible with the insurer so it would be a formal complaint to the Ombudsman. This is possible, but extra energy etc. which I would prefer to put into full recover, instead of a fight.

Basically, I was given a diagnosis of “It’s probably (A), but if he doesn’t recover consider (B)”. I have been recovering, however the insurer has excluded me on the condition of (B) with no evidence to support that is in fact the root cause.

Also, I am recovering well, and I had (some) other cover, so fear not, I will be OK 🙂
