Whose contract overrules the other?

EOB says $0 paid and that I am not responsible based on contract with in network provider.

(Side note this is all after I met my total out of pocket, days after so no fuzzy line of who filed first and in Ohio)

Provider is saying I owe full amount because insurance paid zero and somewhere in their small print I agreed to pay every cent insurance didn’t pay.

Provider is saying our contract overrules everything. Insurance says their contract with provider overrules.

The claim was denied because provider forgot or didn’t fully fill out stuff on their end. Insurance has been contacting them for three months to get the right info. It’s a small town family owned medical equipment provider/ pharmacy. But since I met my total out of pocket they say I do not owe.

It’s one person in the billing department and she is now not answering my calls because insurance used me calling in a conference call to get through to her. She is avoiding our calls, and will hang up once she knows it’s us from another number.

Insurance says they can’t step in with force until after 60 days since the first bill. The bill I got yesterday says this is the last one before collections. And insurance says they are 45 days left in that waiting period. They are trying to call everyday to resolve the issue but can’t threatening anything durning this time.

The bill I got yesterday had a bunch of hand writing all over it demanding payment based on a contract with them. The codes she used and to stop involving insurance. She high lighted the denied part on what I am guessing is their eob, but ignored the part right above it say that’s based on contract agreement patient does not owe. And also highlighted a part that says if claim is denied I agree to owe full amount.

When I give insurance the codes she wrote down it would have been covered, but either way they say not to pay.

I am also being charged interest so the bill goes up each month insurance tells me to toss it.

I think that is everything… so who over rules who? Do I owe because I was in too much pain and high on pain meds to read the small print (I normally do but it was an emergency surgery and stay where the hospital refused to let me leave without a walker… the item bill in question) I just wanted to go home and they told me it was covered ( I had to stay an extra full day because they spend the whole day going back and forth with insurance because I refused to take their walker unless it was covered and said I’ll get one from drug mart on my way home) or do they have to listen to insurance and my eob?
