Hi All,

I have BCBS through my employer. It is a self insured plan and regulated federally. I live in California and have a registered domestic partner. My plan allows me to insure my domestic partner. In our plan documents, they define a domestic partner as a dependent. My domestic partner was recently laid off and lost his insurance coverage in the process. I tried to add him to my health insurance but they’re telling me that it doesn’t qualify for special enrollment. The California Department of Insurance directed me to the US Department of Labor. The US DOL informed me that under HIPAA because our plan defines domestic partners as dependents, this does qualify for special enrollment. Our plan is still denying. Am I missing something here? I’m trying to fight this but they’re dragging their feet. We have supplied them with all documents showing the partnership is registered, we own a home together, have a baby together, etc. I’m really getting frustrated at this point. Any advice is greatly appreciated.
