Newborn coverage first 30 days + birthday rule

I am looking for some help in clarifying coverage for our newborn. My husband and I are both covered separately. We added my newborn to my policy right away and we were also told he was covered for the first 30 days under my policy. We never reported the birth to my husband’s insurance because we didn’t know we ?had to. Now, my insurance is denying coverage of my newborns NICU stay and hospitalization because my husband was born three days before me and they are using the “birthday rule”.

My question is whether or not our newborn was covered automatically for the first 30 days of his life under both policies or if he was just covered under mine? We are in Texas. My husband’s job is asking if he wants to add our son for one month to the policy to help Aetna “offset the cost”. Which we obviously do not want to do.

Do we have any pull here? Do we have to have him covered under my husband’s policy for the first 30 days in Texas?
