MLR Medical Loss Radio Letter from Healthcare Provider says Employer will handle…

I just got a letter from my previous healthcare insurer (expired this summer, we are on a new plan with another carrier now) that said my employer will be receiving a rebate check.

How do I know whether or not my employer will properly send along a rebate to me, if necessary?

For background, this employer has a history of filing incorrect and sometimes downright fraudulent paperwork related to insurance and taxes. They've claimed to have offered us insurance when they didn't and it took months for them to correct this so we didn't have to payback our tax credits. When they finally started offering insurance they accidentally double charged us all for months. They've charged us taxes in the wrong state and sometimes multiples states, which caused us to have to do a lot of extra paperwork during tax season although we did finally get proper refunds for those issues…the list goes on.

They are a 3rd party staffing organization that is located on the other side of the country that is insanely difficult to communicate with.

I guess I'm just concerned that if we are owed any of this rebate, we will never see it and I don't even know how we'd figure that out. Any advice?
