Medicare and inpatient vs observation

Kind of a weird question. My MIL has Medicare and She recently went to the ER for symptoms of stroke. They confirmed that she probably had multiple small strokes and said they were going to admit her. She is now 3 days in, still in the ER but in one of the "rooms", yesterday we insisted on getting her a bed becauae she had been in the cart they typically put you in at the ER. The hospital is saying that while she's considered impatient they're keeping her in the ER because the hospital is too full to move her anywhere. Legally/billing wise how is this handled? Level of care isn't very high as she only sees a doctor one time a day, The nurses only come when she actually calls for them, her meds are constantly late. Unfortunately, there's three hospitals in the area and she chose to go to the worst one, it was her choice, we couldn't fight her on it but I'm trying to figure out if there's a way to fix it at this now. At this point she has been there for over two midnights and they told her she is going to have to stay another day at least because they are waiting on a neurologist to read the MRI (it was completed over 24 hours ago. The only additional med they have placed her on is a Heparin drip.
