Is This Covered by Surprise Billing Law?

My wife gave birth to our son late last year. We went to an in-network hospital in California and most bills were covered at the in-network level which stopped once I reached my $6000 out-of-pocket max for the year. It has been nearly 10 months since the birth and I just received a $1000 bill from the doctor that assisted with the delivery being billed as out-of-network. We never interacted with this doctor before the delivery date and she was merely on staff the day of the birth. My insurance has both an in-network and out-of-network deductible/OOP max. The in-network OOP was met but the out-of-network OOP (which is 3X the in-network) was not since I always try to go in-network. Would this bill be covered by the surprise billing law since the hospital was in-network? Can I or should I fight this?

Also, in case it matters, we were working with an out-of-network midwife that had admitting privileges at our in-network hospital. We had an agreed upon price for services going into the birth. I’ve settled that as agreed but this other doctor intervened and is sending the $1000 bill. I’m hoping this doesn’t mess things up but I need to know if I’m obligated to pay the bill since I already hit my in-network maximum.
