I am obligated to pay for health insurance, if my job offers it at a reasonable price, from a ruling made many years ago. I have no issue providing insurance. The last few jobs that I had did not offer insurance at a reasonable rate (determined by the state laws). My most recent job has signed me up for healthcare to meet this obligation, which again I am for, but how they have done this doesn’t make sense to me.

They determined that the cost of Healthcare for my kid is within the legal limits. The problem is, they are charging me for an entire plan for myself plus my kid, which takes the cost of the Healthcare plan way above the percentage of income that I’m supposed to be spending on insurance. Even though the total cost of the plan is far above the legal limit im obligated to pay, they are arguing that the cost of my kids Healthcare is below the limit since they’re only calculating what it costs to add him to my plan (which I did not previously have nor want). The problem is that the total amount of money im paying I can’t afford and is above the limit legally of the percentage of my income.

I’ve spoken with my company’s provider and they don’t offer plans for just kids, the employee has to be a part of it. I figured as much, but I’m still being forced to pay more than I can afford. The provider said that they would be offer the exception to me if I was able to make a case to the courts. How do I go about doing that?
