Have been separated from my wife for a little over a year. Divorce is a lengthy process which was just finalized last week. We have two children. I also have had a girlfriend for roughly a year. The obvious advice is don’t knock anyone up until well after you’ve been divorced. I started a new job a month ago. Part of their benefits requirements for a domestic partnership includes that neither of us have been married to or legally separated from another individual for the last 12 months. Just found out my girlfriend is pregnant. The company’s benefits center is a call center in a third world country that was almost zero help in answering my questions. Does one scenario trump the other? I was legally married to another individual but am also expecting another child with someone else. Do I sign up just myself and the current kids and then submit a qualifying life event change later? Will that even matter since I’ve still been legally married recently? I don’t really want to risk them pulling benefits from everyone but my kids with my ex wife need insurance May 1st.

In a state that recognizes domestic partnerships.

ETA: I do not provide ex wife with insurance but am providing our kids with insurance. The end goal is get the girlfriend insured.
