Left a FT job in late May for a contractor opportunity.

With summer travel/holidays, lost track of time. Plan was to be added to spouse’s work insurance. Realized we were 35 days after end of coverage and their policy is 30 days. Her HR said they could try to enroll me anyway, but there could be complications if any questions or audits happen by the insurance provider.

Obviously would not be ideal to enroll in something and then lose it. What is the risk level for that happening?

Other compounding factor was my company never sent the Cobra paperwork, so I was unsure of when my last day of coverage was til I called my insurance provider this week. Long story short, the 3rd party HR provider emailed my old work email the Cobra paperwork after I’d already left. Our state law requires it be delivered via mail or in person. Because it’s “mini cobra” it has a 30 day limit (from the date of being informed…which 3rd party HR says has now passed even though I just got the email this week after pressing for it.)

TLDR, Options are:

1) Enroll with spouse and hope the 30 day issue isn’t flagged 2) Push the Cobra issue since I wasn’t legally notified on time 3) ACA plan and ride that out til my spouse’s company allows enrollment next spring
