Just had a question:

(BACKSTORY):

My brother passed away not too long ago. He has a fiancée who is pregnant (kid should be coming soon). The insurance told us the payout would be going to our parents cause he wasn’t married and the baby wasn’t born yet

We all came to the conclusion that the money should go in fund for the baby so he has a better chance at life once he’s responsible with it

Instead the fiancée is saying we did a false claim (we only followed what the insurance told us) and is trying to sue us and the insurance

I won’t talk a lot about all the money we already gave her and all of our offers to help her and the child… the turn was shocking

We want what is best for the child and the mother is not in a good mental place right now (like everyone)

(QUESTION):

Past all the civil drama going on… I was wondering if insurances even pay out to unborn children? Once he’s born, would they change their minds?

TL;DR: brother was unwed but has a son on the way. Insurance says payout goes to parents but ex is suing for it because unborn baby “should be the next beneficiary”. Will payment stay with parents or go to unborn/ soon to be born baby?
