Can I sue my previous employer for not canceling my health insurance policy?

Hey All!

Using a throw away account. For 2 years now I have been going back and forth with my new health plan because my previous employer never cancelled my policy. My new health insurance is denying all my claims in the past couple years because they are "listed as my secondary" and my old policy is showing as my primary.

I had this "fixed" end of 2023 and they(my new health insurance) did pay out. But come Feb my new insurance plan redacted the payments still saying they are not my primary. I now have extensive medical bills that are listed as "no insurance applied" which are beyond past due and I have been stressed that this will effect my credit.

I do have in writing from my previous employer that they did not cancel my policy and they are not sure why this was missed.

Am I able to pursue legal action?

EDIT: forgot to also add I have been working with my employers health concierge all this time, too. They have been no help, except to tell me they will have an update in 1-2 weeks. They've been saying this since last year….
