Can I be refused a surgery after being admitted from the emergency room?
Admitted to the emergency room 3 days ago, found out my medicaid insurance lapsed post pregnancy. Got new insurance through marketplace. Doesn’t take effect until December 1st.
Came in unable to walk or straighten leg or het into sitting position without severe leg and back pain. Have to be helped getting dressed, standing, going to the bathroom. Etc. Cannot function.
Had to advocate for myself as they didn’t want to do an MRI on my back at first at the er, just kept pushing fentanoland making me try to walk. . Glad they did because w found out my disc is slipped so badly in my back that it’s compressing the nerve that goes down my back and leg.
They admitted me to the hospital, and came amd talked to me.
Pain got worse, started getting leg weakness and tingling on top of the pain, pulling and tightness.
They suggested a Spinal epidural of steroids. Had that yesterday.
Pain consists , only change is shooting pain across back now instead of one spot.
Doctors are saying I might need surgery if the shot doesn’t work..
However one doctor basically slipped and said surgery would obly be an option depending on if insurance covers it. I said that I had thought a emergency had to be taken care of despite insurance. She agreed. But was trying to downplay my issues and saying I’m not having “true weakness and true numbness” that she thinks it’s just from pain. Even though on full pain meds and muscle relaxers the pulling, tightness pain and weakness persists. I can tell the difference between not being able to do something from pain and not physically being able to make myself do the thing due to something else. These are 2 different symptoms and I’m having both.
Now all the doctors after are saying that they aren’t recommending surgery right now, and not considering it unless there’s no improvement from the shot. That I’ll be here a few days while they monitor for improvement and try to get me into physical therapy.
Physical therapy came by today and left because I couldn’t do anything they needed me to do.
Now I’m wondering if they would or could even send me home in this condition, and if they could legally refuse a surgery i might possibly need ( shaving down the disc to relieve the compression of the nerve) just because I don’t have active insurance? Is this legal to do? Does not being able to walk or sit due to weakness and pain from a severely compressed nerve not constitute an emergency?
