Hello all. I have a question about the birthday rule in Tennessee.

My wife and I got married on December 20th, and our daughter decided to join us about 5 1/2 weeks early the very next day. Prior to our marriage, I had my own health insurance through the marketplace, and my wife had hers through work.

Our daughter spent 2 weeks in the NICU (she is doing great now 😊) Somehow amongst the shock, sleep deprivation and my wife’s recovery, we did manage to cancel my health insurance on the 21st and add me to her plan through a qualifying life event. My wife works for and has insurance through the hospital where we delivered our baby.

Now, 4 months later, we just received notice through a benefits coordinator that my wife’s insurance is denying our claims and sending them instead to my insurance company via the birthday rule. They are claiming that even though we canceled my policy and added me to hers, mine was “still effective” through Dec. 31. We already have a health payment plan with the hospital set up and everything is based on what my wife’s insurance said they were going to cover.

What’s the best way to go about navigating this to get these claims covered under our current family insurance, and not my previous (and frankly not good) marketplace plan?
