Letter of Representation for National Flood Insurance Claims

During my flood speech this morning at the Florida Association of Public Insurance Adjusters (FAPIA) Conference, a discussion about letters of representation was raised. FAPIA Vice President Frank Altieri noted that federal law applied and that the Florida regulations regarding providing a contract to the insurer do not apply. Instead, federal flood adjusters require a letter from the policyholder notifying them that the public adjuster has authority to represent the policyholder.

The letter must include a declaration statement prescribed by 28 U.S.C. 1746: “I declare (or certify, verify, or state) under penalty of perjury that the foregoing is true and correct.”

Frank was kind enough to share the form his firm has been successfully using for this purpose.
