I met my out of pocket maximum in early March of this year, but before I realized that I paid two $50 copays to one of my providers for visits on 5/2 and 5/16. After multiple 3-way calls with my insurance company and my provider’s office, I finally received a refund of the copay from my 5/16 office visit. However, every time I request a refund of my 5/2 copay, I’m told by my provider’s office that I have to wait until my insurance processes for my most recent visit (I see this provider regularly, every 4 weeks and sometimes every 2 weeks). By the time the last visit has processed, another visit has occurred, and I get the same answer. At this rate I won’t get my refund until sometime in 2025. Is my provider correct they they are allowed to withhold the refund of my copay—which they shouldn’t have charged me in the first place as the EOB makes clear—until all subsequent charges are processed by my insurance?
