Misrepresentation of billing practices

Hey guys, got an issue I’m hoping to get some advice on. I get a couple medications through Lincare pharmacy, and have been getting some bills I thought I shouldn’t have these last 4 months.

After speaking with my insurance and Lincare multiple times, I’ve found out why.

Lincare apparently bills medications as a Durable Medical Equipment supplier and not a pharmacy. So I’ve been being billed $231.00 for a drug that I now find I can get at Walmart for $7.00 and $56.00 for another I can get at Walmart for like $3.00.

My doctor is who sent it in to them, he never informed me of how they bill, Lincare never informed me of how they bill, and they do present themselves as Lincare Pharmacy Services. Not as a DME. I’ve never received anything from them where they represent themselves as a DME.

I’m obviously changing who fills the prescription, and will be changing doctors. But is there any recourse for the money already spent. I mean, it just seems to me that they just found a loophole that allows them to bill $231 for a drug that other pharmacies bill $7 for.
