I'm covered by my company's insurance plan. My plan in 2023 covered IVF "Up to 3 cycles or 45,000". I did 3 cycles in 2023 and spent 25,000.

We sign up for insurance every year. In 2024 the plan coverage changed and IVF was covered "up to 45,000 lifetime maximum, no cycle limit"

The plan was telling me that since I met my lifetime max in 2023 with the 3 cycles I was no longer eligible.

The department of labor investigated and my company showed them a phrase in a plan guide that says "members who completed 3 cycles are no longer eligible." The problem is that was that phrase was in the plan guide for union employees – I'm a nonunion employee. I have a different plan guide and that phrase is definitely NOT in my plan guide.

I pointed that out to them but still have not gotten a response. Do you think its time for a lawyer and that I'll be successful?
