Oscar & hospital screwed up billing – 1 year later getting collections, legal recourse?

Hello, I’m looking to see if I can go after Oscar and/or the hospital where I had a procedure.

I paid my ENTIRE deductible upfront at the time of the procedure as this is what I was presented with. After the procedure, the deductible showed as met, everything seemed to be fine. Then after a few months my deductible showed as not met. I started getting bills from providers related to the procedure. I never got any refund so for me the deductible was met. I’ve exchanged hundreds of messages and emails with Oscar and they were completely useless. Eventually after I contacted my state insurance department to file a complaint it emerged that Oscar overpaid the hospital, and as such they put all other payments on hold. I’m the mean time, I was getting collections notices.

Fast forward to this year, I get a refund from the hospital, no letter or phone call. I had a few hits on my credit because of the collections that I never paid (since I had met my deductible and Oscar had failed to properly pay the providers). In theory it shows that I owe a few providers with this refund and that’s ok, I will pay them now that I got a refund.

I want to know if I have any legal recourse related to my credit score being affected by Oscar/hospitals incompetence?

Thank you
