Employer forcing me to take part in their health insurance — I have my own insurance.

Hello everyone, I am in need of some advice regarding an employer forcing me to take part in their health insurance.

Quick information:

-The workplace is in Southern California (I live here), and the employer company is in Virginia. -I’m a federal security contractor to a government agency. -This new company took over our contract recently, and we have been going through hiring and benefits plans. (I am a hired, full time employee, and it is open enrollment) -I have my own Kaiser Platinum Insurance, and have had Kaiser my entire life. -We are Not unionized, and there is no CBA.

During open enrollment, I have waived medical/dental/vision insurance, as I have that all covered on my own. My employer is denying me the ability to waive the medical insurance, because since my Kaiser plan is not a “group” plan, I am not allowed to waive medical.

They stated: employees that receive a Health and Welfare (H&W) benefit in accordance with the Service Contract Act (SCA), you have to be enrolled in a credible group health insurance plan outside of *Company* in order to waive medical coverage offered by *Company*. In order to waive the medical insurance you must be enrolled in a credible group health plan (insurance through another employer/spouses employer, or Tricare) and produce proof of other credible group coverage.

I provided them with the group & subgroup number to my Kaiser plan, where they still insist it does not qualify and I have to sign up with their insurance.

I would lose out on roughly $700/month of my Health and Welfare benefits and I would still have to pay for my Kaiser insurance on top of that. Their insurance does NOT cover enough for my disability.

I have a documented disability protected by the ADA, could I request an accommodation or get an ADA attorney to fight to allow me to keep my own insurance? All my prescriptions, medications, doctors, specialists, are with Kaiser. I will do anything to keep my own insurance.

What options do I have?

Our 7 year contract with our past company was from 2016 – 2023 end of Feb. I had no issue with my own insurance and to keep my Health & Welfare with the previous company. We are still located at the same Federal Facility, just with a new “contracted company”.
