Is there a health insurance board to file formal complaint to Optum Financial for continuously not allowing me and my spouse to reimburse ourselves the money out of our Health Savings Account?

Between my spouse and I, who both left our jobs at which the HSA accounts were opened in 2020, a total of $300-500 in fees over years were deducted our HSA accounts for no reason.

We lost our jobs in mid 2020. Starting in May 2020, Optum began deducting from both of our HSA accounts monthly $5.50 “account maintenance fee” despite that we had continuously maintained a balance over $1000-2000 — but in fact, some fees should have been waived or lessened according tot heir policy

Optum claimed that I never sent them the account rollover form when I left Amazon in April 2020— but in fact, I have fax record that I indeed faxed and called them to roll over to my next employer (which I also left).

I also have records of me submitting reimbursements on the Optum/ConnectYourCare website and disputes regarding unauthorized charges and Optum purposefully delaying the process beyond 180 days so they can continuously bill us the maintenance charges.

The HSA maintenance fee varies according to different Optum websites. After many CFPB complaints, I finally were able to get what’s left of our HSA accounts to be reimbursed. Last month, Optum customer service only gave me back $22 (4 months of HSA fees) back as “courtesy”, my spouse is yet to hear anything, and I’m trying to demand more compensation from this deceptive bank.
